1. Acceptance of Terms
By downloading, installing, or using RelicLens (the “App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and Eversight (“we,” “us,” or “our”).
2. Description of Service
RelicLens is an antique identification and appraisal guidance application. The App uses AI-powered image analysis to identify antiques and provide estimated value ranges based on comparable market data. The information provided by the App is for reference purposes only and does not constitute a professional appraisal, valuation, or authentication.
3. No Professional Appraisal
The identification results, value estimates, condition assessments, and other information provided by the App are generated by automated AI analysis and are intended as guidance only. They should not be relied upon as professional appraisals, formal valuations, or authentication certificates. We strongly recommend consulting qualified appraisers or experts for high-value or important items. We are not liable for any decisions made based on information provided by the App.
4. User Accounts and Conduct
You agree to:
- Use the App only for lawful purposes and in accordance with these Terms
- Not use the App in any way that could damage, disable, or impair the service
- Not attempt to gain unauthorized access to any part of the App or its systems
- Not use the App to infringe upon the intellectual property rights of others
- Not transmit any harmful, offensive, or illegal content through the App
5. Subscriptions and Payments
RelicLens offers Premium subscription plans that provide additional features. By purchasing a subscription:
- Payment will be charged to your Apple ID account at confirmation of purchase
- Your subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours before the end of the current period
- Any unused portion of a free trial, if offered, will be forfeited when a subscription is purchased
- You can manage and cancel subscriptions in your Apple ID account settings
6. Intellectual Property
The App, including its content, features, and functionality, is owned by Eversight and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
7. User Content
You retain ownership of the photos and images you submit through the App. By submitting content, you grant us a limited license to process and analyze your content solely for the purpose of providing our identification and appraisal services. We do not claim ownership of your content and do not use it for any other purpose.
8. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY IDENTIFICATION RESULTS OR VALUE ESTIMATES.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EVERSIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.
10. Indemnification
You agree to indemnify, defend, and hold harmless Eversight and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the App or violation of these Terms.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the “Last updated” date. Your continued use of the App after any changes constitutes acceptance of the new Terms.
12. Termination
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
